Controller and contact

Enrique Alejandro de la Cruz Pineda and Manuel Isaías Pech Maas, providing services under the trade name Notaría Pública 101, at Calle Reno 33, S. M. 20, Mza. 20, interior 4, Cancún, Quintana Roo, Mexico, postal code 77500, are joint controllers of your personal data.

Privacy enquiries are received at legal@notaria101.com and at the address above, Monday–Friday, from 9:00 AM to 6:00 PM.

02

Information we process

Depending on the service requested, we may collect the following directly, through file documents or by legally permitted means:

  • Identification and contact: name, address, telephone, email, date of birth, nationality, official identification, CURP, RFC, signature and representatives' details.
  • Information about the act: marital status, family relationships, matrimonial property regime, details of beneficiaries, heirs, shareholders and other participants, and the necessary legal records.
  • Financial and property information: real estate, rights, transaction values, payment methods, accounts, tax information and source of funds where applicable.
  • Images and biometric information: images recorded by security cameras and fingerprints used for identification or formalisation of an act.
  • Sensitive data: health or capacity information necessary for the matter, and biometric information where its nature or use could create a serious risk for the person. This receives enhanced protection.

Information about minors or represented persons is collected through those legally authorised to act, except where the applicable law provides otherwise. We request only data relevant to each purpose.

03

How we use your information

The purposes necessary for providing services and performing the notarial function are:

  • Answering enquiries, arranging assessments, preparing estimates and following up matters.
  • Verifying identity and representation; assembling files, reviewing records, and preparing, formalising and retaining instruments and related documents.
  • Carrying out procedures, registrations and communications necessary for the requested act.
  • Invoicing and complying with tax, identification, anti-money-laundering, authority-reporting and record-retention duties.
  • Protecting people, premises and documents through video surveillance; documenting and investigating security incidents.
  • Using fingerprints to verify identity or include them in an act when necessary and appropriate.

Processing relies on consent where required and on the applicable legal duties or legal relationship. Financial or property data require express consent, and sensitive data require express written consent, unless a legal exception applies. Visiting the site alone does not authorise fingerprint collection or promotional messages.

04

Promotions: your choice

As a secondary purpose, we may send promotional information about our notarial services and service campaigns. You will be included only with your prior, express and separate authorisation.

You may decline from the first contact or withdraw that authorisation by emailing legal@notaria101.com with the subject “Stop promotional messages” and the email address or number to exclude. This does not affect the provision of services. File documents are not required to request removal from promotions; we may verify the contact channel to handle the request correctly.

05

Tools and providers

The notarial office uses Pipedrive for management and follow-up, WhatsApp for communication and Google Drive for storage and document collaboration, as well as video-surveillance systems and fingerprint readers. Access must be limited to the information necessary for each function.

A provider processing information on the office's behalf must be subject to instructions, confidentiality and security measures. Cloud services may involve processing outside Mexico. Where a provider acts for its own purposes, its terms and privacy notice also apply; this does not replace the office's obligations.

Read the conditions of Pipedrive, WhatsApp and Google. You may call or visit the office to arrange an appropriate way to deliver documents.

06

When information may be shared

Depending on the act, necessary information may be communicated to tax and anti-money-laundering authorities, public registries, notarial authorities and archives, courts or other competent authorities. It may also be shared with financial or trustee institutions, parties or representatives whose involvement is necessary to formalise or carry out the matter.

Communications are limited to the applicable purpose and legal basis. Where a transfer is not covered by a legal exception, the relevant consent will be requested and its recipient and purpose explained before it occurs. Promotional authorisation does not authorise sharing your file with third parties for advertising.

07

Retention and security

Files, instruments, tax documents and identification records are kept for the periods required by notarial, tax and anti-money-laundering law and the liabilities relating to the matter. Some records form part of archives subject to custody and delivery to authorities under notarial law.

Security recordings and biometric records are kept for the period necessary for the stated purpose and applicable duties. An incident or preservation obligation may justify retaining the related records longer. You can request the period applicable to your case through the privacy email.

Once the purpose and required periods have ended, the applicable blocking, deletion, return or delivery takes place. A cancellation request does not remove legal archival obligations.

Protection requires administrative, physical and technical measures, access control and confidentiality. If a security breach significantly affects your property or non-property rights, you will be informed as required by law.

08

Your rights and how to exercise them

You may request access, rectification, cancellation or objection (ARCO) by emailing legal@notaria101.com or submitting a written request at the office. Include your name, reply contact, requested right and information needed to locate the matter. Verify your identity and, where applicable, representation. For rectification, specify the correction and provide supporting information. Identifying specific data is not required when requesting access.

The decision will be communicated within 20 business days and, if granted, implemented within the following 15 business days. Each period may be extended once for an equal period with justification. You will be informed if the request needs additional information. Exercising these rights is free, except for legally permitted reproduction or delivery costs.

Access will be provided through inspection or secure delivery, as appropriate. Any legal limitation, including third-party information or retention duties, will be explained. You may approach the competent Mexican authority, Secretaría Anticorrupción y Buen Gobierno, under the applicable procedure if you believe your rights have been infringed.

09

Withdrawal and restrictions

You may withdraw consent or request limits on use or disclosure through the same email and procedure stated for ARCO requests. Specify the purpose to suspend and a contact channel. Identity will be verified for requests concerning the file. The stated response periods apply, and you will be informed of the measure's scope.

Withdrawal has no retroactive effect. If a legal obligation requires processing to continue or the information is necessary for the legal relationship, the circumstance and its effects on the service will be explained. For promotions, use the direct removal procedure in section 04.
