Making a will in Cancun: preparing for your notarial assessment

Prepare for a will consultation in Cancun: your wishes, intended beneficiaries, questions and documents for reviewing your circumstances.

A first consultation about a will can begin with a simple question: how do you want your assets and rights to be dealt with after your death? A will is a personal, voluntary and revocable act. Clearly explaining your wishes helps prepare the consultation.

Prepare your wishes and questions

Consider whom you wish to benefit, which family circumstances need explaining and what questions you have about distributing your estate. Mention minors, dependants or particular circumstances so that the relevant provisions can be considered.

You do not need to resolve every legal question yourself before the assessment. Bring your questions and ask for an explanation of the options applicable to your circumstances.

Useful information to have ready

  • Your identification and personal details.
  • Details of the people you wish to name in your will.
  • Information about any previous wills.
  • A description of the family or property circumstances you wish to discuss.

Before the assessment, confirm the specific documents, attendance requirements and any support needed to communicate during the execution of the will.

If your circumstances have changed

A will is revocable and can be changed. A change in your wishes or circumstances is a reason to ask whether it should be updated. Mention any existing will so that the matter can be reviewed properly.

Also ask which document you will receive, how to keep it and whom you may wish to inform of its existence. Notaría Pública 101 handles enquiries about wills in Cancun and the requirements for each case.
